1. Acceptance of Terms
Welcome to TMM Const. These Terms of Service ("Terms") govern your access to and use of the TMM Const website, platform, online courses, educational materials, webinars, coaching sessions, and all related services (collectively, the "Services") operated by TMM Const, located at 651 Garrison St, Lakewood, CO 80215, United States.
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Services.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

3. Account Registration and Security
To access certain features of our Services, including course enrollment, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your username and password.
You are solely responsible for all activities that occur under your account. You agree to notify TMM Const immediately of any unauthorized use of your account or any other breach of security. TMM Const shall not be liable for any loss or damage arising from your failure to comply with these security obligations.
Account sharing is strictly prohibited. Each account is licensed for use by a single individual only. Sharing login credentials with others, or allowing multiple users to access a single account, constitutes a violation of these Terms and may result in immediate account termination without refund.
4. Services Description
TMM Const provides online educational services including, but not limited to:
- Self-paced online courses covering business, artificial intelligence, e-commerce, and digital marketing
- Pre-recorded video lessons and tutorials
- Downloadable educational materials, templates, checklists, and worksheets
- Live webinars, masterclasses, and interactive workshops
- One-on-one coaching and mentorship sessions
- Community forums and discussion groups
- Certificates of completion for successfully finished programs
The specific content, schedule, availability, and pricing of our Services may be updated, changed, or discontinued at any time without prior notice. TMM Const reserves the right to modify course content, instructor assignments, and program structures as we deem necessary to maintain the quality and relevance of our educational offerings.
5. Enrollment and Payment
By enrolling in a course or purchasing a plan, you agree to pay all applicable fees as displayed on our website at the time of purchase. All prices are listed in United States Dollars (USD) unless otherwise specified. Prices are subject to change without prior notice, although changes will not affect orders that have already been processed and confirmed.
Payment must be made in full at the time of enrollment unless an installment plan option is expressly offered and selected. We accept major credit cards, debit cards, and other payment methods as displayed on our checkout page. You represent and warrant that you are authorized to use the payment method you provide.
All payments are processed through secure third-party payment processors. TMM Const does not store your complete payment card information on our servers. By making a purchase, you also agree to the terms and conditions of our third-party payment processor.
6. Intellectual Property Rights
All content included in or made available through our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, software, course materials, slide presentations, workbooks, and all other educational content (collectively, "Content"), is the exclusive property of TMM Const or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
Upon enrollment and payment, TMM Const grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal, non-commercial educational purposes. This license does not include the right to:
- Reproduce, distribute, publicly display, or publicly perform any Content
- Modify, adapt, translate, or create derivative works based on the Content
- Resell, sublicense, rent, lease, or lend access to the Content
- Record, screen-capture, or otherwise copy video lessons or live sessions
- Share, upload, or distribute Content on any third-party platform or service
- Use the Content for any commercial purpose, including training others or creating competing products
Violation of these intellectual property provisions may result in immediate termination of your account and access, without refund, and may subject you to legal action for damages.
7. User Conduct
When using our Services, you agree not to engage in any of the following prohibited activities:
- Violating any applicable local, state, national, or international law or regulation
- Engaging in harassment, abuse, or threatening behavior toward instructors, staff, or fellow students
- Posting or transmitting any content that is unlawful, defamatory, obscene, or otherwise objectionable
- Attempting to gain unauthorized access to our systems, servers, or databases
- Interfering with or disrupting the Services or networks connected to the Services
- Using automated systems, bots, scrapers, or similar tools to access or interact with the Services
- Impersonating any person or entity or misrepresenting your affiliation with any person or entity
- Uploading viruses, malware, or any other harmful code
TMM Const reserves the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these conduct standards, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.
8. Disclaimers and Limitations of Liability
THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TMM Const does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. TMM Const does not guarantee any specific results from the use of our Services. Educational outcomes depend on individual effort, prior experience, market conditions, and numerous other factors beyond our control.
IN NO EVENT SHALL TMM CONST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF TMM CONST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO TMM CONST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless TMM Const, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Services, your Content submissions, or your violation of any rights of another party.
10. Termination
TMM Const may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
If you wish to terminate your account, you may do so by contacting our support team. Please note that account termination does not automatically entitle you to a refund; please refer to our Refund Policy for applicable terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Jefferson County, Colorado, and you consent to the personal jurisdiction of such courts.
Any claim or cause of action arising out of or relating to these Terms or the Services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
13. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TMM Const regarding the use of the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
