1. Overview
At TMM Const, we are committed to delivering high-quality educational content and an exceptional learning experience. We understand that making an investment in your education is a significant decision, and we want you to feel confident in your purchase. This Refund Policy outlines the terms and conditions under which refunds may be issued for our online courses, programs, coaching sessions, and related services.
We encourage all prospective students to carefully review our course descriptions, curriculum outlines, pricing information, and any available preview materials before making a purchase. If you have any questions about a course or program, please contact our admissions team before enrolling to ensure the program is the right fit for your learning goals.
By purchasing any course, plan, or service from TMM Const, you acknowledge that you have read, understood, and agree to the terms of this Refund Policy.
2. Refund Eligibility
2.1 Self-Paced Online Courses
For self-paced online courses (including the Starter, Professional, and Executive plans), refund requests are accepted within fourteen (14) calendar days of the original purchase date, provided that the following conditions are met:
- You have completed no more than 20% of the total course content (measured by video lessons watched and modules accessed)
- You have not downloaded or otherwise retained any course materials, templates, workbooks, or supplementary resources
- You have not received or redeemed a certificate of completion for any course included in your purchase
- You have not participated in any live sessions, webinars, or Q&A events included in your plan
If all of the above conditions are met, you may submit a refund request, and we will process a full refund minus any applicable processing fees charged by our third-party payment processor.
2.2 Live Webinars and Masterclasses
Refund requests for live webinars, workshops, and masterclasses must be submitted at least seventy-two (72) hours before the scheduled event start time. Refund requests submitted less than 72 hours before the event, or after the event has taken place, will not be eligible for a refund. If a live event is cancelled or rescheduled by TMM Const, attendees will be offered the option of a full refund or transfer to the rescheduled event.
2.3 One-on-One Coaching Sessions
Refund requests for one-on-one coaching sessions are accepted for unused sessions only. If you have purchased a package of coaching sessions, you may request a refund for any sessions that have not yet been scheduled or conducted. Sessions that have already been delivered (whether in full or in part) are non-refundable.
Cancellation of individual coaching sessions must be made at least forty-eight (48) hours before the scheduled appointment. Late cancellations or no-shows will be counted as a completed session and are not eligible for refund or rescheduling.
2.4 Installment Plans
If you enrolled in a program using an installment payment plan and wish to request a refund, the refund amount will be calculated based on the total amount paid to date minus the value of any services or content already consumed, and minus any applicable processing fees. If a refund is approved, any remaining installment payments will be cancelled.
3. Non-Refundable Items and Services
The following purchases and services are not eligible for refunds under any circumstances:
- Courses, programs, or plans where more than 20% of the content has been accessed or completed
- Purchases made more than fourteen (14) calendar days ago
- Any course or program for which a certificate of completion has been issued
- Live events that have already occurred
- Coaching sessions that have already been conducted
- Downloadable resources that have been accessed or downloaded
- Promotional, discounted, or bundled purchases (unless otherwise stated in the promotional terms)
- Gift purchases or transfers to another person
- Purchases where the user's account has been suspended or terminated due to a violation of our Terms of Service
4. How to Request a Refund
To initiate a refund request, please follow these steps:
- Send an email to support@tmm-const.com with the subject line "Refund Request - [Your Full Name]"
- Include your full name, the email address associated with your account, and your order or enrollment number
- Clearly state the reason for your refund request and identify the specific course, plan, or service for which you are requesting a refund
- Provide any additional information or documentation that may support your request
Our team will acknowledge receipt of your request within two (2) business days and will review your request within five (5) business days from the date of acknowledgment. We may contact you for additional information or clarification during the review process.
5. Refund Processing
If your refund request is approved, the refund will be processed using the original payment method. Please allow the following processing times:
- Credit/Debit Cards: 5-10 business days for the refund to appear on your statement, depending on your card issuer
- Bank Transfers: 7-14 business days for the refund to be reflected in your account
- Other Payment Methods: Processing times may vary depending on the payment provider; please allow up to 14 business days
TMM Const is not responsible for delays caused by your bank, credit card company, or other financial institution. If you have not received your refund within the expected timeframe, we recommend first contacting your financial institution before reaching out to our support team.
Any third-party transaction fees, processing fees, or currency conversion fees charged by payment processors are non-refundable and will be deducted from the refund amount where applicable.
6. Chargebacks and Disputes
We strongly encourage you to contact us directly to resolve any billing concerns before initiating a chargeback or dispute with your bank or credit card company. Filing a chargeback without first attempting to resolve the issue with TMM Const may result in the immediate suspension or termination of your account and access to all Services.
If a chargeback is filed, TMM Const reserves the right to dispute the chargeback and provide evidence of service delivery to the payment processor. We also reserve the right to pursue collection of any amounts owed through appropriate legal channels.
7. Course Transfers and Exchanges
In lieu of a refund, TMM Const may, at our sole discretion, offer you the option to transfer your enrollment to a different course or program of equal or lesser value. If the alternative course or program is of greater value, you will be responsible for paying the difference. Course transfers are subject to availability and may only be exercised once per enrollment.
8. Force Majeure
TMM Const shall not be held liable for any delay or failure in providing Services due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, cyberattacks, or other force majeure events. In such circumstances, we will make commercially reasonable efforts to resume Services as soon as practicable and may offer alternative arrangements such as extended access periods or rescheduled events.
9. Modifications to This Refund Policy
TMM Const reserves the right to modify this Refund Policy at any time. Any changes will be effective immediately upon posting on our website with a new "Last Updated" date. Changes to this Refund Policy will not apply retroactively to purchases made before the effective date of the changes. We encourage you to review this policy periodically for any updates.
10. Severability
If any provision of this Refund Policy is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
11. Governing Law
This Refund Policy shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising from this Refund Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Jefferson County, Colorado.
